Q: Why are there so many bad truck accidents, I see something terrible almost every day?

Due to their size and weight, tractor trailers are inherently dangerous and regularly cause great damage and injuries to others, particularly on our highways.  Due to this, they are highly regulated and are prohibited from many roadways.  Even with these precautions, they frequently injure and kill other motorists in horrific and shocking accidents.

Q:I hope these huge trucks have to carry a lot of insurance?

Because of this, interstate trucking companies are required, under Federal Law, to carry a minimum of between $750,000.00 and $5,000,000.00 of insurance, depending on what they are transporting.  The upper limits are for carriers of hazardous materials. (49 CFR 387.9).

Q:Why are there so many accidents with these big rigs?

Their sheer size and weight are the main reasons why they have such bad accidents.  When involved in an accident with a big rig, there are numerous causes which may have been contributing factors.  These include: too many hours or days on the road, lack of maintenance, improper loading, brake failure and many others.  These are some of the issues you must consider, as well as where to file suit.

Q:What do you mean “where to file” don’t I have to file where it happens?

You need to examine the most favorable jurisdiction, or Court, in which to file your suit. Known as “forum shopping” It might be where the accident occurred or where you live.  It might even be where the trucking company is located.  A good attorney will explore where you are most likely to obtain the best outcome for your lawsuit.
